  2. ICL Builder License Agreement

  4. License Agreement
  5. The use of ICL Builder is subject to the following terms and conditions.
  6.  
  7. Title To The Licensed Software
  8. Title to the licensed software is NOT transferred to the end user. The 
  9. end user is granted an exclusive license to use the software on a SINGLE 
  10. computer or computer work station. EACH computer or computer work station 
  11. must have its own licensed copy of the software.
  12.  
  13. Copyright Protection
  14. ICL Builder is copyrighted material. It is protected by the copyright
  15. laws of the United States, the State of Colorado, and other proprietary
  16. rights of Sloop Software. You may not make any changes or modifications to 
  17. ICL Builder.  You may not decompile, disassemble, or otherwise 
  18. reverse-engineer the software in any way.
  19.  
  20. You may make copies of ICL Builder only under the terms of the
  21. section entitled "Limited License To Copy The Licensed Software".
  22.  
  23. You may use ICL Builder on a trial basis provided you do not violate the
  24. protection afforded the licensed software by the copyright laws, and 
  25. you agree to the terms of the license agreement. If you use ICL Builder
  26. on a regular basis you are obligated to purchase it.
  27.  
  28. Limited Warranty
  29. Sloop Software does not warrant that the licensed software will meet your 
  30. requirements or that the operation of the software will be uninterrupted or 
  31. error free.  The warranty does not cover any media or documentation which has 
  32. been subjected to damage or abuse by you.

  34. The software warranty does not cover any copy of the licensed software which 
  35. has been altered or changed in any way.
  36.  
  37. ANY IMPLIED WARRANTIES INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS 
  38. FOR A PARTICULAR PURPOSE ARE LIMITED TO THE TERM OF THE EXPRESS WARRANTIES. 
  39. Some states do not allow limitations on how long an implied warranty lasts, 
  40. so the above limitation may not apply to you.

  43. Other Warranties
  44. The warranties set forth above are in lieu of any and all other express or 
  45. implied warranties, whether oral, written, or implied, and the remedies set 
  46. forth above are the sole and exclusive remedies.

  49. Limitation Of Liability
  50. Sloop Software is not responsible for any problems or damage caused by the 
  51. licensed software that may result from using the licensed software. This 
  52. includes, but is not limited to, computer hardware, computer software, 
  53. operating systems, and any computer or computing accessories. End user agrees 
  54. to hold Sloop Software harmless for any problems arising from the use
  55. of the software.

  57. Sloop Software SHALL NOT IN ANY CASE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, 
  58. CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING FROM ANY BREACH OF 
  59. THESE WARRANTIES EVEN IF Sloop Software OR ITS AGENTS OR DISTRIBUTORS HAVE 
  60. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  Some states do not allow 
  61. the exclusion or limitation of incidental or consequential damages, so the 
  62. above limitation or exclusion may not apply to you.

  64. In no case shall Sloop Software's liability exceed the license fees paid for 
  65. the right to use the licensed software, or a sum no greater than one Dollar 
  66. ($1.00), whichever is less.
  67.  
  68. Limited License To Copy The Software
  69. You are granted a limited license to copy ICL Builder ONLY FOR THE TRIAL USE
  70. OF OTHERS subject to the terms of this software license agreement 
  71. described herein, and the conditions described below are met: ICL Builder
  72. MUST be copied in an unmodified form and ICLBLD.ZIP MUST contain the following
  73. files:

  75.   ICLBUILD.EXE  - the executable for ICL Builder
  76.   ICLBUILD.HLP  - ICL Builder help file
  77.   README.TXT    - this file
  78.   INSTALL.EXE   - install program
  79.   METER.DLL     - dll for install
  80.   SETUP.INF     - setup information
  81.   ICONDLG.DLL   - icon link library
  82.   BWCC.DLL      - dialog link library
  83.   ORDERFRM.TXT  - order form
  84.   LICENSE.TXT   - license information
  85.   VENDOR.DOC    - shareware vendor information
  86.   FILE_ID.DIZ   - program description
  87.   CEOPRESS.TXT  - information on CEO:Desktop Manager

  89. -> No fee, charge or other compensation may be accepted or requested by anyone
  90.  without the express written permission of Sloop Software.
  91.  
  92. Public Domain Disk Vendors May NOT CHARGE a fee for ICL Builder themselves.
  93. However, you may include either program on a diskette for which you charge
  94. a nominal distribution fee. The purchaser of said diskette must be informed
  95. in advance that the fee paid to acquire the diskette does NOT relieve said 
  96. purchaser from paying the registration fee for either ICL Builder if said
  97. purchaser uses either program.
  98.  
  99. -> Operators of electronic bulletin board systems (Sysops) may post ICL Builder
  100. for downloading by their users without written permission ONLY AS LONG AS THE
  101. ABOVE CONDITIONS ARE MET.  A fee may be charged for access to the BBS 
  102. AS LONG AS NO SPECIFIC FEE IS CHARGED FOR DOWNLOADING the program files without 
  103. first obtaining express written permission from Sloop Software to charge such a fee.

  105. The above constitutes the license agreement for ICL Builder. It supersedes any
  106. and all previous license agreements.
